By using phon.ist, you agree to these terms. We've written them in plain language to make them easy to understand.

Introduction

Welcome to phon.ist. These Terms of Service ("Terms") govern your use of our AI-powered phone announcement generation service. By accessing or using our service, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our service.

Service Description

phon.ist provides an AI-powered text-to-speech service that generates professional phone announcements for PBX systems. Our service includes:

  • • AI-powered voice generation using OpenAI and ElevenLabs technology
  • • Pricing of €3 per announcement
  • • Instant preview with watermark before purchase
  • • Final export in MP3 or WAV format after payment
  • • Optimized audio presets for various telephony systems (Generic, STARFACE, 3CX, Asterisk)

User Obligations

When using our service, you agree to:

  • • Provide accurate and truthful information when placing an order
  • • Ensure that any content you submit complies with applicable laws and regulations
  • • Use the service only for lawful purposes
  • • Not attempt to reverse engineer, decompile, or extract voice models from generated audio

Prohibited Uses

You may not use our service to:

  • ⚠ Generate content for spam, harassment, or illegal activities
  • ⚠ Impersonate individuals or entities without authorization
  • ⚠ Create content that violates intellectual property rights
  • ⚠ Generate content that is defamatory, discriminatory, or harmful

We reserve the right to refuse service or terminate accounts that violate these prohibitions.

Intellectual Property

Your Content: You retain all rights to the text content you submit to our service. By submitting content, you grant us a license to process it through our service to generate the audio file.

Platform Rights: All rights, title, and interest in the phon.ist platform, including its design, functionality, and underlying technology, remain the property of phon.ist.

Generated Audio: Upon payment and delivery, you receive a license to use the generated audio file for commercial purposes. You may use the audio file in your PBX systems, phone announcements, and related business activities.

Voice Models: The underlying voice models used to generate audio are the intellectual property of OpenAI and ElevenLabs, respectively. You do not acquire any rights to these voice models.

Payment Terms

Pricing: Each announcement costs €3. Payment is processed securely through Stripe.

Payment Processing: All payments are handled by Stripe. We do not store or process credit card information directly. By making a payment, you agree to Stripe's terms of service.

Refunds: Due to the digital nature of our service and the availability of a preview before purchase, we do not offer refunds after the final audio file has been delivered. If you encounter technical issues that prevent you from receiving your file, please contact us at hello@phon.ist.

VAT: For customers within the European Union, VAT is included in the price as required by EU tax regulations. Customers outside the EU are not charged VAT.

Service Availability

We strive to provide reliable service, but we cannot guarantee uninterrupted availability. Our service depends on:

  • • Third-party TTS providers (OpenAI, ElevenLabs) whose services may experience downtime
  • • Infrastructure maintenance and updates
  • • Network connectivity and external factors beyond our control

We provide the service on a "best-effort" basis and are not liable for service interruptions or unavailability.

Liability Limitations

Service Provided "As Is": Our service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

Limited Liability: To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from your use of the service.

Maximum Liability: Our total liability for any claims arising from or related to the service shall not exceed the amount you paid for the specific announcement in question (€3).

Content Policy

You are solely responsible for ensuring that any content you submit complies with applicable laws, including but not limited to copyright, trademark, privacy, and defamation laws. We reserve the right to refuse service or remove content that we determine, in our sole discretion, violates these Terms or applicable law.

If you believe that content generated through our service infringes your intellectual property rights, please contact us at hello@phon.ist with a DMCA takedown notice. We will respond to valid notices in accordance with applicable law.

Termination

We reserve the right to suspend or terminate your access to the service at any time, with or without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties, or for any other reason.

You may stop using the service at any time. Termination of your access does not affect your rights to use previously generated and delivered audio files for which you have paid.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of Germany, without regard to its conflict of law provisions.

Any disputes arising from or related to these Terms or the service shall be subject to the exclusive jurisdiction of the courts of Germany, or as otherwise required by applicable EU consumer protection laws.

If you are a consumer resident in the European Union, you may also be entitled to use the EU Online Dispute Resolution platform to resolve disputes. For more information, visit https://ec.europa.eu/consumers/odr.

Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes by posting the updated Terms on this page and updating the "Last Updated" date.

Your continued use of the service after such changes constitutes your acceptance of the updated Terms. If you do not agree to the updated Terms, you must stop using the service.
